Victorious Resolution of International Trade Contract Dispute Case
Recently, our firm successfully concluded an international trade contract dispute case on behalf of a U.S. enterprise against a Chinese supplier in an international goods sales contract. The case involved a procurement contract for auto parts valued at over $1 million, where the supplier delayed delivery by unilaterally altering product specifications, resulting in significant commercial losses for the buyer. Faced with the supplier’s defense claiming that “the buyer modified technical parameters,” our professional team precisely identified the legal disputes, achieving breakthroughs through a tripartite strategy of negotiation-arbitration-mediation.
During the CIETAC arbitration proceedings, we systematically applied the United Nations Convention on Contracts for the International Sale of Goods (CISG) and ICC arbitration rules. We established a robust proof system for the supplier’s breach of contract. Through an innovative hybrid dispute resolution model combining phased mediation with arbitration leverage, we secured a full settlement agreement within three months, recovering all payments and loss of profits for the client, while ensuring timely compensation disbursement.
